END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is between you ("User" or "You") and Busy Eye Games ("Company," "We," "Us", or "Our"). By installing, accessing, or using the mobile game Brain Rage at the Office ("Game"), you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not install, access, or use the Game.

1. LICENSE GRANT

Busy Eye Games grants you a non-exclusive, non-transferable, and revocable license to use the Game solely for personal, non-commercial entertainment purposes on your mobile device, subject to the terms and conditions of this Agreement. Contact Us to negotiate a license for commercial purposes.

2. USE OF THE GAME

• You may only use the Game in accordance with its intended functionality.

• You are prohibited from modifying, reverse-engineering, decompiling, or disassembling the Game.

• You may not distribute, sell, rent, lease, or sublicense the Game.

• You must not engage in any activity that may harm or disrupt the Game's operation.

3. LICENSE TO STREAM OR USE GAME FOOTAGE FOR NON-COMMERCIAL PURPOSES

You are granted a limited, non-exclusive, and non-transferable license to capture, stream, record, and share footage from the Game ("Game Footage") for non-commercial purposes, including on social media platforms such as YouTube, Twitch, and Instagram, subject to the following conditions:

• You may not monetize or profit directly from the Game Footage (e.g., via ads, sponsorships, or paid promotions).

• You may not use Game Footage in any way that is offensive, defamatory, illegal, or infringes upon the rights of others.

• You must not alter or edit the Game Footage in a way that misrepresents or distorts the Game’s content or branding.

• Busy Eye Games reserves the right to revoke this license if it deems your use of the Game Footage violates the terms of this Agreement.

4. DATA COLLECTION

Busy Eye Games does not collect any personal information or data from users while they use the Game. We do not track, store, or share any personally identifiable information (PII) related to your use of the Game. During your use of the game, your brain activity is stored temporarily for the duration of a few frames (less than a second) in order to derive cognitive data used directly by the game's mechanics. This data is stored locally in your device and is destroyed as soon as it is no longer used and/or after the game is closed. For more information about this use of your biometric data, consult the Game's Neurorights Observance Notice. In the event that we collect and store any personal data in the future, we will comply with all applicable data protection laws, including but nor limited to the EU's GDPR. Users shall be notified in-game of any such policy changes.

5. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise disclosed in the in-game credits, all intellectual property rights, including copyrights, trademarks, and patents, related to the Game are owned by Diego Saldivar. This license grants you only the right to use the Game as specified herein and does not transfer any ownership of the Game or its intellectual property to you.

6. LIMITED WARRANTY AND DISCLAIMER

The Game is provided "as is," and Busy Eye Games makes no warranties regarding the Game's performance, reliability, or availability. To the maximum extent permitted by law, Busy Eye Games disclaims any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Specifically, Busy Eye Games does not make any health, medical or scientific claims regarding the use of the Game. The Game is intended for ludic purposes only.

7. LIMITATION OF LIABILITY

In no event shall Busy Eye Games be liable for any damages, including but not limited to, direct, indirect, incidental, special, consequential, or punitive damages, arising from your use or inability to use the Game, even if Busy Eye Games or their representatives has been advised of the possibility of such damages.

8. TERMINATION

This Agreement is effective until terminated. You may terminate this Agreement at any time by uninstalling the Game from your device. Busy Eye Games may terminate this Agreement at any time if you breach any of its terms. Upon termination, you must cease all use of the Game and delete it from your device.

9. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement is governed by the laws of the Kingdom of Spain. Any disputes arising under or in connection with this Agreement shall be resolved through binding arbitration in Madrid, Spain, in accordance with the rules of the Courts and Tribunals of the City of Madrid.

10. MODIFICATIONS TO THIS AGREEMENT

Busy Eye Games reserves the right to modify or update this Agreement at any time. Any such changes will be effective immediately upon posting within the Game or on Busy Eye Games' website. Your continued use of the Game after such changes constitutes your acceptance of the modified Agreement.
